PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. YOU SHOULD UNDERSTAND THAT BY USING ANY OF OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

1. INTERPRETATION

The following definitions and rules of interpretation in this condition apply in these Terms:-

  • “Order”: your instruction to supply any Product or Products;
  • “Product”: all products specified in the Order to be bought by you from us (including any part or parts thereof);
  • “Terms”: the terms and conditions specified herein; and
  • “You/Your”: the person making the Order.

Headings used in these Terms do not affect the interpretation of them.

2. JURISDICTION

The laws of Scotland shall apply.

3. INFORMATION ABOUT US

  • www.carolmcmillansoaps.co.uk is a website (“the Site”) operated by Carol McMillan Soaps, a business whose main trading address is The West Lodge, Stobo, Peeblesshire, EH45 8NY, Scotland.


4. YOUR STATUS

Nothing in these terms affects your statutory rights.  By placing an order through the Site, you warrant that:-

  • You are legally capable of entering into binding contracts;
  • You are at least 18 years old;

5. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

  1. After placing an Order, you will receive an e-mail from us or from our payment processing company acknowledging that we have received your Order. Please note that this does not mean that your Order has been accepted.Your Order constitutes an offer to us to buy a Product. All Orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (“the Dispatch Confirmation”).
  2. The contract between us (“the Contract”) will only be formed when we send you the Dispatch Confirmation.
  3. These Terms shall apply with full effect to the Contract from when we send you the Dispatch Confirmation.
  4. The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your Order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
  5. For the avoidance of doubt, the reference to any Product on the Site is not an offer by us to sell the Product. Any such reference is an invitation to treat only.


6. CONSUMER RIGHTS

1. If you are contracting as a consumer, your statutory rights are not affected and you may cancel a Contract at any time within seven working days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy (set out in section 10 below).
2. To cancel a Contract, you must inform us in writing and return the Products to us immediately, in the same condition in which you received them,and at your own cost and risk.


7. AVAILABILITY AND DELIVERY

1. Your Order will be fulfilled as soon as possible after we have received it, and within 28 days of the date of the Order Confirmation, unless there are exceptional circumstances.
2. If a Product which you ordered is out of stock, the Product will be replaced with its nearest substitute.


8. RISK AND TITLE

1. The Products will be at your risk from the time of delivery.
2. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
3. Our products are suitable for children and adults over 36 months of age.
4. Our products are believed to be safe and have been used by many hundreds of people, however there may be a possibility of an allergic reaction in some sensitive individuals. Therefore it is suggested to try a small amount first as a precaution.


9. PRICE AND PAYMENT

1. The price of any Products will be as quoted on the Site from time to time, except in cases of obvious error.
2. These prices exclude delivery costs, which will be added to the total amount due as set out on the Site or in the Dispatch Confirmation.
3. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
4. The Site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on the Site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a Product’s correct price is higher than the price stated on the Site,we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your Order and notify you of such rejection.
5. We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.
6. Payment for all Products must be by credit or debit card, cheque, postal order or PayPal account (if you have one). We accept payment with the following cards: Visa Credit, Visa Debit, Visa Electron, Solo, Maestro, JCB, American Express.


10. OUR REFUNDS POLICY

1. When you return a Product to us (for instance, because you have cancelled the Contract between us, or because you claim that the Product is defective, we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will usually process the refund due to you as soon as possible and, in any case, within 28 days of the day we received your cancellation or the day we confirmed to you via e-mail that you were entitled to a refund for delivery of the defective Product.
2. Only products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.
3. Products returned by you within the seven-day cooling-off period described in paragraph 6.1 above will be refunded in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us.


11. OUR LIABILITY

1. We warrant to you that any Product purchased from us through the Site is of satisfactory quality.
2. Our liability in connection with any Product purchased through the Site is strictly limited to the purchase price of that Product.
3. We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

Q: How much will I be charged for delivery?
A:Delivery is calculated by weight.  There may be special offers on delivery charges from time to time.  You will be able to see the cost of delivery before making payment.


Q: When will my order be delivered?
A: Orders will be despatched as soon as possible after your order is received. However, please allow up to 28 days for delivery.


Q: Can I order by telephone or post?
A: Yes, orders can be placed by telephone or post as well as through the online shop. If you would like to order by telephone, please visit the Contact page to view my contact details.

Q: What happens if a product I order is out of stock?

Q: Which payment methods do you accept?
A: If you order using the online shop or by telephone, you can pay using any credit or debit card. Orders placed online can also be paid for by using your PayPal account if you have one. Orders made by post can also be paid for by cheque or postal order made payable to 'Carol McMillan'.


Q: Can you gift wrap my order?
A: All products are available gift wrapped for a fee of £1 per item. Please contact me for further details. Also, if you would like to include a gift card, or details of your desired gift card, I will include it in the gift wrapping.

Q: Can you send items to delivery addresses outside the UK?
A: Items can be sent to delivery address overseas for an additional postage charge. Please contact me for more details and exact pricing.


Q: What is your cookie policy?
A: Quite simply, cookies are necessary for the proper functioning of the shop.  We do not use any third-party or tracking cookies.  Your use of the site constitutes acceptance of the cookie policy.  You have nothing to worry about regarding use of cookies on this site.  Please do not block cookies (except third-party cookies) as this will stop the site working for you.


Q. What is your privacy policy?
A. Please see our Privacy Policy page.  We will not sell or rent your personal data to anyone else and it will only be used to properly run the business and provide you with the goods and services we offer.  From time to time we may send you special offers by email.  If you object to receiving special offers by email, please contact us.

This is a truly one-woman business! All products are made by me from beginning to end here in my workshop on the smallholding. I make the creams in small batches of around twelve items per time. All are environmentally friendly, biodegradable, not tested on animals and have a very minimal carbon footprint. Products are hand made here and sent directly to you. The ingredients chosen are Soil Association certified whenever possible.

The palm oil that I use has for years been exclusively Soil Association Certified.
There are no synthetic colourings, no GMOs, no petrochemicals, no animal testing, and no fillers. I also never add paraben preservatives or sodium laurel sulphate.


Traditionally hand-made soap
The term 'hand-made' is confusing. It can be used for ready-made soap that is bought in, melted, bits added and poured into moulds. I like to invent my own recipes and choose ingredients for specific skin types. Like my customers, I like to know what is in my soap!
Moisturising milk from my own small herd of dairy goats enhances all of my soaps.I tend the goats daily and continue to hand milk. My herd's high-quality yield is ensured through grazing chemical free pasture, supplemented by local meadow hay and home-mixed cereals. During the winter or when the weather is harsh, comfort is found in a spacious straw-bedded wooden barn. On the rare occasion when nature needs a helping hand, I always prefer to use homeopathic remedies.

Natural ingredients
Only natural spring water is used in my recipes. The palm oil that I use has for years been exclusively Soil Association Certified.

Much of the fun of soapmaking for me comes from selecting tempting natural ingredients from my workshop shelves.

Balmpots - kind to skin and many uses.
I often receive letters of thanks from people with sensitive skin.

I am glad that customers are enjoying the Balmpots. New packaging ideas are on the way. They are kind to the skin and have many different uses. Pure Peace of Mind Cream - Small batches are regularly made using pure oils and beeswax.A blend of Rose Geranium and Lavender essential oils added benefit to mind and body.The number of customers who write to tell me of the comfort that this original cream brings always encourages me. I get news of it being used as a a moisturising cream for very dry complexions. Babies' bottoms, hand cream, flaky skin, nourishment to strengthen nails, sunburn - the list goes on.
